1. Acceptance of Terms

By accessing or using Demonstrable ("the Service"), operated by Nonatomic ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use after such notification constitutes acceptance of the modified Terms.

2. Description of Service

Demonstrable is a demonstration linking tool that allows developers to create shareable links to live demos. The Service enables users to:

  • Upload screenshots and associate them with demo URLs
  • Generate markdown snippets for embedding in documentation
  • Track click analytics on demo links
  • Organize demos into collections
  • Receive feedback from viewers

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account using Google OAuth. You are responsible for maintaining the security of your account and for all activities that occur under your account.

3.2 Account Requirements

  • You must be at least 16 years old to use the Service
  • You must provide accurate and complete information
  • You may not create accounts on behalf of others without authorization
  • You may not share your account credentials with others

3.3 Account Termination

You may delete your account at any time through the Account Settings page. We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine is harmful to the Service or other users.

4. Acceptable Use Policy

You agree not to use the Service to:

  • Upload, share, or link to illegal, harmful, or offensive content
  • Distribute malware, viruses, or malicious code
  • Engage in phishing, fraud, or deceptive practices
  • Infringe on intellectual property rights of others

5. User Content

5.1 Ownership

You retain ownership of the content you upload to the Service, including screenshots, descriptions, and other materials ("User Content"). By uploading User Content, you represent that you have the right to do so.

5.2 License Grant

By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute your User Content solely for the purpose of operating and providing the Service.

5.3 Content Responsibility

You are solely responsible for your User Content. We do not endorse or verify User Content and are not liable for any content uploaded by users. We reserve the right to remove content that violates these Terms.

6. Intellectual Property

6.1 Our Rights

The Service, including its design, features, and code (excluding User Content), is owned by Nonatomic and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our permission.

6.2 Trademarks

"Demonstrable" and related logos are trademarks of Nonatomic. You may not use our trademarks without prior written consent.

6.3 Feedback

If you provide feedback or suggestions about the Service, you grant us the right to use that feedback without compensation or attribution.

7. API Usage

If you access the Service via our API, you agree to:

  • Use API tokens responsibly and keep them secure
  • Respect rate limits and usage quotas
  • Not share API tokens with unauthorized parties
  • Identify your application properly in API requests

We may revoke API access for violations of these Terms or our API guidelines.

8. Service Tiers and Payments

The Service offers different tiers with varying features and limits. Free tier users are subject to usage limits. Paid tiers may be offered with additional features. Payment terms, if applicable, will be disclosed at the time of purchase.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We are not responsible for the content, accuracy, or availability of external websites linked through the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NONATOMIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER IN CONTRACT, TORT, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless Nonatomic and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any third-party rights

12. Third-Party Services

The Service may integrate with or contain links to third-party services. Your use of such services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

13. Governing Law and Disputes

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved exclusively in the courts of England and Wales.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nonatomic regarding the Service and supersede any prior agreements.
